Warranty
ADVANCED TURF TECHNOLOGY 2 YEAR WARRANTY FOR TMSystem® PRODUCTS
A. GENERAL PROVISIONS
Advanced Turf Technology will repair or replace, at its option, any parts (except those specified in Section C, Items not covered) of TMSystemTM products, as delivered to the original retail purchaser, that are defective in material or workmanship.
B. WHAT IS WARRANTED
- Basic Machine Warranty.
All parts of the TMSystemTM product are covered by warranty for a total of 24 months, unlimited hours, from the date of delivery/Installation.
C. ITEMS NOT COVERED
Advanced Turf Technology is not responsible for the following:
- Premiums charged for overtime labour requested by the purchaser.
- Service calls made by the distributor.
- Used products.
- Any product that has been altered or modified in ways not approved by Advanced Turf Technology.
- Depreciation or damage caused by normal wear, lack of reasonable and proper protection during storage, or accident.
- Normal maintenance and replacement of maintenance and wear items, such as blades and other cutting parts, bearings and fasteners.
D. PARTS REPLACED UNDER WARRANTY
Only new or remanufactured parts or components furnished or approved by Advanced Turf Technology, will be used to repair the product. If any such part or component is defective in material or workmanship when installed in the product, Advanced Turf Technology will repair or replace, as it elects, such defective part or component, provided the defect is reported to an authorized TMSystemTM distributor within ninety days of installation or before expiration of the product’s warranty, whichever is earlier.
E. SECURING WARRANTY SERVICE
To obtain performance of this warranty, the original retail purchaser must request warranty service from a TMSystemTM Distributor authorized to sell the product to be serviced. When making such a request, the purchaser must present evidence of the product’s delivery date, make the product available at the distributor’s place of business, and inform the distributor in what way the purchaser believes the product to be defective.
F. NO IMPLIED WARRANTY OR OTHER REPRESENTATION
Where permitted by law, neither Advanced Turf Technology nor any company
affiliated with it makes any warranties, representations or promises as
to the quality, performance or freedom from defect of the product covered
by this warranty.
NO IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS IS MADE.
G. LIMITATION OF PURCHASER’S REMEDIES
Where permitted by law, the purchaser’s only remedies in connection with the breach of performance of any warranty on Advanced Turf Technology Products are those set forth on this page. In no event will the distributor, Advanced Turf Technology or any company affiliated with Advanced Turf Technology be liable for incidental or consequential damages, including but not limited to loss of profits, rental of substitute equipment or other commercial loss.
H. NO DISTRIBUTOR WARRANTY
The selling distributor makes no warranty of its own on any item warranted by Advanced Turf Technology and makes no warranty on any other item unless it delivers to the purchaser a separate written certificate specifically warranting the item.
THE DISTRIBUTOR HAS NO AUTHORITY TO MAKE ANY REPRESENTATION OR PROMISE ON BEHALF OF ADVANCED TURF TECHNOLOGY, OR TO MODIFY THE TERMS OR LIMITATIONS OF THIS WARRANTY IN ANY WAY.
